Family Files Claim in Mesa Boy’s Death

MESA (By Kim Smith, Tribune) 2004 - The family of a 15-year-old Mesa boy shot and killed by officers in August is demanding an apology or $60 million from Mesa.
Mario Madrigal Jr. died Aug. 25 after officers shot him while responding to a suicidal person call at his home in the 500 block of South Johnson.

An investigation by Maricopa County Attorney Richard Romley’s office concluded the shooting was justified. In announcing the decision in October, Romley said forensic evidence disproved family accounts of the shooting, and statements from officers and other evidence confirmed they fired their weapons because they feared for their lives.

The boy’s parents, Mario Sr. and Martha Madrigal, said police shot their son even though a stun gun had caused the boy to drop his knife.

According to a notice of claim filed Feb. 16, the boy’s parents want each of
the seven officers who responded to the house to admit the shooting was "totally unjustified."

Moreover, they want the city to apologize and admit that the official report is false. They also want the city to implement a training program for situations involving mentally ill, emotionally disturbed and impaired people.

Should the city refuse, the family intends to file a lawsuit seeking $60 million.
Mesa detective Tim Gaffney declined to comment, citing a department policy against discussing pending litigation.
